PRIVACY POLICY

The present Data Protection and Privacy Policy regulates the treatment of personal data facilitated by the User through the Web Site that ArsCorporate makes available to Internet users. The present Policy forms an integral part of the Legal Disclaimer accessible at all times from the Web Site.

The User guarantees that the information provided is true, exact, complete and up to date, being responsible for any damage or harm, direct or indirect, that could be caused as a consequence of the non-fulfilment of this obligation. In the case that the data provided belong to a third party, the User guarantees that he has informed the said third party of the aspects contained in this document and obtained his authorization and consent to provide his data to ArsCorporate for the indicated purposes.

The Web Site may offer functionalities to share content through third party applications, such as Linkedin, Facebook or Twitter. These applications can collect and process information related to the User’s navigation in the different websites. Any personal information collected through these applications may be used by third party users of these applications, and their interactions are subject to the privacy policies of the companies providing the applications.

The Web Site may host blogs, forums, and other applications or social networking services in order to facilitate the exchange of knowledge and content. Any personal information provided by the User may be shared with other users of that service, over which ArsCorporate has no control.

With the aim of offering information or services of interest depending on the location of the User, ArsCorporate may access data related to the geolocation of the User’s device, in those cases where the configuration of the User to this effect allows it.

For the purposes of technical security and system diagnosis, in an anonymous or aggregated form, ArsCorporate may register the IP address (identification number of the device’s Internet access, which allows devices, systems and servers to recognize and communicate with each other). This information may also be used for web performance analysis purposes.

For what purpose are the User’s personal data processed?

ArsCorporate treats the information provided by the User with the aim of attending to the different types of requests made by the User. Depending on the nature of the request, the purpose will be to manage (i) consultations and requests for proposals (RFPs) sent through the contact form provided for this purpose, (ii) CVs sent through the Web Site, (iii) participation in blogs, through comments, (iv) subscription to exclusive ArsCorporate content, (v) surveys, (vi) electronic communications of an informative and promotional nature, in accordance with their interests. ArsCorporate may prepare a commercial profile based on the information provided. No automated decisions will be made based on that profile.

In the event that the User registers on the Web Site through the social login, ArsCorporate will only access the User’s personal data for which he has given his consent during the configuration of access to the social network in question. Any information provided in connection with these social applications could be accessed by members of the corresponding social network. These interactions will be governed by the privacy policies of the entities providing the services. ArsCorporate has no control over or responsibility for such entities or their use of User information.

 

Information about the processing of data for sending communications from ArsCorporate

The data used, or provided, in the informative and/or promotional communications are treated by ArsCorporate for purposes consisting of the electronic sending of information and communications about services, activities, publications, celebrations, greetings and social and professional events or events of ArsCorporate or third parties in the network of ArsCorporate firms in the consultancy and digital sector; the monitoring and optimization of marketing campaigns carried out by means of technologies to that effect; and the elaboration of profiles with commercial purposes using contact data and their preferences.

The legal basis for the aforementioned processing is the express consent granted by the owner. In each of the communications received, the User may cancel their subscription by using the mechanism provided for this purpose. The criterion for the conservation of the data will be based on the statement to the contrary of the processing by the owner. In any case, the User can exercise their rights of access, rectification, opposition, cancellation, portability and limitation of treatment, as well as raise any questions regarding the processing of their personal data via email gdpr[@]arscorporate.com.

 

How long are the User’s personal data kept?

In general, the personal data provided will be kept for the time necessary to deal with the User’s request or until the User requests its deletion. In the specific case of CVs, the data will be kept for a maximum period of three years, unless the interested party indicates otherwise.

 

What is the legitimacy for the processing of the User’s personal data?

The legal basis for the processing of data is the legitimation by consent of the User.

 

To which recipients will the User’s personal data be communicated?

The data may be transferred to administrations and public bodies for the fulfilment of obligations directly applicable to ArsCorporate.

In those cases in which the User accepts to attend events organized or sponsored by ArsCorporate in collaboration with other entity/entities that sponsor, co-organize or provide services, the personal data may be provided to them, based on the legitimate interest of identifying those attending the event that they organize or sponsor, as well as controlling access to the facilities where the event is held.

 

What are the User’s rights when providing personal data?

The User has the right to obtain confirmation as to whether ArsCorporate is processing personal data concerning him/her, as well as the right to access his/her personal data, request the rectification of inaccurate data or, where appropriate, request their deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

Under certain circumstances, the User may request that the processing of his or her data be limited, in which case they will only be kept for the exercise or defence of claims.

Under certain circumstances and for reasons related to their particular situation, the User may oppose the processing of their data. ArsCorporate will cease to process the data, except for legitimate and compelling reasons, or the exercise or defence of possible claims.

The User may exercise the right to have his or her data transferred in a structured, commonly used and machine-readable format to another data controller. Such action may involve a reasonable fee to be paid by the User, depending on the administrative costs incurred in meeting the request, in accordance with the regulations.
